Обоснование. Цифровизация образования в России актуализирует проблему соответствия инновационных педагогических практик действующему законодательству. Широкое использование образовательных платформ, социальных сетей, мессенджеров и цифровых портфолио создает правовые риски, связанные с обработкой персональных данных детей (152-ФЗ) и распространением информации (436-ФЗ). Проблема исследования заключается в том, что правовые ограничения часто воспринимаются педагогами как внешнее бюрократическое препятствие, а не как фактор, конструктивно влияющий на дидактический выбор и качество образовательной среды. Это приводит либо к правовым нарушениям, либо к отказу от эффективных цифровых инструментов. Цель – выявить и проанализировать механизмы влияния правовых норм на методический арсенал учителя в цифровой среде и разработать модель правомерного дидактического выбора. В ходе исследования проанализированы ключевые нормативно-правовые акты, проведен анализ типичных цифровых педагогических ситуаций, выявлены основные дефициты правовой грамотности педагогов. Материалы и методы. Концептуально-правовую основу исследования составляют ключевые нормативные акты РФ: Федеральные законы «Об образовании в Российской Федерации», «О персональных данных» (152-ФЗ) и «О защите детей от информации, причиняющей вред их здоровью и развитию» (436-ФЗ). В работе использован комплекс взаимодополняющих методов: нормативно-догматический метод для анализа законодательства и метод моделирования педагогических ситуаций для перевода абстрактных правовых норм в плоскость конкретных дидактических решений. Результаты показывают, что интеграция правового знания в педагогическое мышление позволяет не только минимизировать риски, но и повысить осознанность, системность и безопасность применения цифровых технологий в обучении. Реализация правовых норм на практике трансформируется из формального ограничения в элемент педагогической работы.
Background. The digitalization of education in Russia highlights the problem of compliance of innovative pedagogical practices with the current legislation. The widespread use of educational platforms, social networks, messengers, and digital portfolios creates legal risks related to the processing of children's personal data (152-FZ) and the dissemination of information (436-FZ). The challenge of this research lies in the fact that legal restrictions are often perceived by educators as an external bureaucratic obstacle rather than a factor that can positively impact the choice of teaching methods and the quality of the educational environment. This can lead to either legal violations or a reluctance to use effective digital tools. The purpose is to identify and analyze the mechanisms of the influence of legal norms on the methodological arsenal of a teacher in the digital environment and to develop a model of legitimate didactic choice. During the study, key legal acts were analyzed, the analysis of typical digital pedagogical situations was carried out, and the main deficiencies of teachers' legal literacy were identified. Materials and methods. The conceptual and legal basis of the study is formed by the key regulatory acts of the Russian Federation: Federal Laws "On Education in the Russian Federation", "On Personal Data" (152-FZ) and "On Protection of Children from Information Harmful to Their Health and Development" (436-FZ). The work uses a complex of complementary methods: the normative-dogmatic method for the analysis of legislation and the method of modeling pedagogical situations for the translation of abstract legal norms into the plane of specific didactic solutions. The results show that integrating legal knowledge into pedagogical thinking not only minimizes risks, but also enhances awareness, systematization, and security of digital technologies in education. The implementation of legal norms in practice transforms from a formal limitation into an element of pedagogical work.
